2. Opening an Account 

2.1 You must be at least 18 years old and a resident of the United Kingdom to open an account with Last Fan Standing. It is illegal for anyone under 18 or residing outside the UK to use our services. If we discover that you do not meet these criteria, your account will be closed, any deposits refunded, and any winnings voided. 

2.2 Accounts may only be opened via our mobile application.Requests to open accounts by any other means will not be accepted. 

2.3 We reserve the right to request proof of age and residence from any customer. Failure to provide satisfactory documentation may result in the suspension or closure of your account. 

2.4 We may use third-party agencies to verify the personal information you provide. If we cannot verify your details, you will be asked to submit additional proof of identity and address. Acceptable forms of verification include:   -

2.8 You are only permitted to hold one account with us. If multiple accounts are identified, we reserve the right to close or restrict all related accounts and cancel any outstanding bets. 

2.9 In the event of an erroneous credit to your account, we are entitled to make appropriate adjustments. If the erroneously credited funds are withdrawn, you are required to reimburse the full amount immediately upon request. 

2.10 We are not liable for any losses incurred due to unauthorized access to your account. It is your responsibility to safeguard your account from unauthorized use, including by minors. We accept no liability for unauthorized access, whether fraudulent or otherwise.

3. Your Account 

3.1 Customer funds are held entirely separately from company funds in a customer account separated from our normal, day-to-day business accounts. 3.3 It is your responsibility to comply with any applicable tax obligations related to your betting activities. 

3.4 To participate in our services, you must deposit funds into your account via our third-party electronic payment processors. You authorize us to instruct these processors to handle deposits and withdrawals in accordance with your instructions and activity on our platform.

3.6 You must not use our services for any illegal or inappropriate purposes, including but not limited to defamatory, abusive,obscene, or discriminatory behavior. Violation of this clause may result in immediate account closure.

4. Closure, Suspension, and Termination of Accounts 

4.1 We reserve the right to suspend or close your account at any time, for any reason, including but not limited to breaches of these Terms and Conditions. 

4.2 You may close your account at any time. Once an accounts closed, it cannot be reinstated, and any outstanding bets will be forfeited without entitlement to winnings. 

4.3 Failure to comply with our Terms and Conditions, game rules, or privacy policy may result in the following actions:   - Immediate, temporary, or permanent suspension of your account.   - Removal of any content posted by you on our platform.  - Disqualification from active bets and forfeiture of winnings.   - Issuance of warnings or further legal action as necessary.   - Disclosure of information to law enforcement or third-party complainants as required. 4.4 The actions outlined in 4.3 are not exhaustive, and we may take any additional steps deemed necessary.

5. Entry Fees and Prize Money 

5.1 Entry fees and prize money distribution vary depending on the game type, number of participants, and specific game rules. Refer to individual game rules for detailed payout information. 

5.2 We reserve the right to decline any entry fee payment tour discretion.

5.4 If a charge-back, reversal, or cancellation of payment occurs, the total prize pool will be reduced by the corresponding amount. We will not apply our administration fee to any voided entry fees.

5.5 We reserve the right to void all entry fees and winnings if we suspect collusion, fraud, or any other prohibited behaviour among participants. 

5.6 We may alter, suspend, or remove any of our services without prior notice. 

6. Dealing with Errors and Information Technology Issues 

6.1 We do not guarantee that our services will be free from technical issues or errors.  

6.2 If a fault or bug is identified, we will inform you and outline the steps being taken to resolve the issue. 

6.3 Should you notice an error, please notify us immediately. We may temporarily suspend your account while we resolve the issue. 

6.4 We are not liable for any losses, including potential winnings, resulting from technical faults, bugs, or user errors. 

6.5 We reserve the right to void entire games, individual entries, or outcomes if deemed necessary for the integrity of the game and in the best interests of all participants.

7. Our Liability

7.6 Our maximum liability for any claim related to the use of our services shall be limited to the average joining fee paid by the claimant in the previous six months. 

7.7 Nothing in these Terms and Conditions affects your statutory rights. 

8. Intellectual Property Rights 8.1 All intellectual property rights related to the content,design, graphics, software, and branding of Last Fan Standing are owned by us or licensed for our use. Unauthorized use of our intellectual property is strictly prohibited. 

9. Assignment

9.1 You may not assign or transfer any rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations to any third party, including in the event of a business transfer. 

10. Waiver 

10.1 Failure by us to enforce any part of these Terms and Conditions does not constitute a waiver of our rights. Any waiver must be in writing and does not affect our right to enforce any subsequent breach.

11. Indemnity 

11.1 You agree to indemnify and hold us harmless from any claims, losses, or damages, including legal fees, arising from your negligence,unauthorized use of our services, or breach of these Terms and Conditions.

12. Entire Agreement 

12.1 These Terms and Conditions constitute the entire agreement between you and Last Fan Standing regarding the use of our services and supersede any prior agreements or understandings. 

13. Third Parties 

13.1 Our platform may contain links to third-party resources for informational purposes. We do not control the content of these resources and are not responsible for their accuracy or reliability. 

13.2 These Terms and Conditions are not intended to confer rights on any third party, except as expressly stated. No third party shall have the right to enforce any provision of these Terms.  

14. Complaints Procedure and Governing Law & Jurisdiction

14.1 If you have any query or dispute relating to a past or current transaction, please contact us at games@lastfanstanding.net as soon as reasonably possible. If your issue is not resolved after speaking with our customer services team, you may request that it be escalated to a manager or supervisor. A senior member of our team will review the matter in more detail and aim to respond with a resolution within 72 hours. You will be provided with the name and position of the person handling your complaint.

14.2 Either party may refer the dispute to an independent third party, such as the Independent Betting Adjudication Service (IBAS). Last Fan Standing Ltd agrees to abide by IBAS’s decision (except in the case of manifest error). Disputes relating to entry fees will not be subject to litigation, court proceedings, or objections to a licence or permit (including any remote operator or personal licence), unless Last Fan Standing Ltd fails to uphold the outcome determined through arbitration.

14.3 IBAS offers a free, impartial service that adjudicates on disputes related to betting and gaming transactions (note: it does not handle customer service issues).

14.4 A copy of our complaints procedure is available upon request or will be provided when a complaint is submitted.
